NOTICE OF PASSING OF BYLAW NO. 2022-92 BEING A BYLAW TO ADOPT A COMMUNITY IMPROVEMENT PROJECT AREA AND BYLAW NO. 2022-93 BEING A BYLAW TO ADOPT A COMMUNITY IMPROVEMENT PLAN BY THE CORPORATION OF THE TOWNSHIP OF NORTH DUNDAS

TAKE NOTICE that the Council of The Corporation of the Township of North Dundas passed Bylaw No. 2022-92 and Bylaw No. 2022-93, on the 6th day of December 2022, under Section 28 of the Planning Act, R.S.O 1990 as amended.

AND TAKE NOTICE that any person or public body may appeal to the Ontario Land Tribunal in respect of the Bylaw by filing with the Clerk of The Corporation of the Township of North Dundas not later than the 3rd day of January, 2023 a notice of appeal, setting out the reasons in support of the appeal, accompanied by the fee prescribed under the Ontario Land Tribunal (payable to the Minister of Finance). If the fee does not accompany the appeal, the Local Planning Appeal Tribunal has the power to dismiss the appeal pursuant to subsection 34(25) of the Planning Act.

Only individuals, corporations and public bodies may appeal a bylaw to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the bylaw was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal there are reasonable grounds to add the person or public body as a party.

EXPLANATORY NOTE
THE COMMUNITY IMPROVEMENT PLAN provides existing commercial/industrial businesses with financial incentives to improve their buildings exterior facade, signage, building interior and/or the property. Financial incentives will be in the form of grants and/or loans made available through the Community Improvement Plan for eligible applicants. In addition, where a Phase I Environmental Site Assessment (ESA) exists, the program offers support for completing a Phase II ESA and other subsequent analysis. The Regional Incentives Program further supports businesses by offering grants for building and property improvements. The complete plan is available for review on the Township website.
