NOTICE OF THE PASSING OF A ZONING BY-LAW AMENDMENT BY THE CORPORATION OF THE TOWNSHIP OF NORTH DUNDAS

TAKE NOTICE that the Council of The Corporation of the Township of North Dundas passed By-law No. 2022-43, on the May 31st 2022, under Section 34 of the Planning Act, R.S.O 1990 as amended.

AND TAKE NOTICE that any person or public body may appeal to the Ontario Land Tribunal (the Tribunal) in respect of the By-law by filing with the Clerk of The Corporation of the Township of North Dundas not later than the 20th day of June 2022, a notice of appeal, setting out the reasons in support of the appeal, accompanied by the fee prescribed under the Ontario Land Tribunal Act ($1,100.00 payable to the Minister of Finance).

Only individuals, corporations and public bodies may appeal a By-law to the Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the By-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal there are reasonable grounds to add the person or public body as a party.

An explanation of the purpose and effect of the By-law, describing the lands to which the By-law applied is shown below. The complete By-law is available for inspection during normal office hours at the Township office located at 636 St. Lawrence Street in Winchester

EXPLANATORY NOTE

Purpose and Effect of the By-law

The Township of North Dundas has received an application to amend the former Township of Mountain Zoning Bylaw No. 79-6 to amend zoning on the subject property, currently zoned Rural (RU), to Rural Exception 28- Holding (RU-28h) to permit the construction of a multi-family home with a holding clause to ensure there is adequate water and septic capacity.

The lands affected by this amendment are described as Part of Lot 3, on Plan 8M8, being Part 1 on Registered Plan 8R5730, Former Township of Mountain, now the Township of North Dundas. County of Dundas.

If the proposed bylaw amendment is adopted, the applicant will be permitted to construct a multi-family home on the subject property, provided that the applicant can provide a suitable hydrogeological report and septic permit to the Township for the proposed high-density dwelling.

The property/land to which the proposed Zoning Bylaw amendment applies is subject to another application under Section 41 of the Planning Act.
